MAKE CREATIVE STUDIO TERMS AND CONDITIONS

 

General

 

1. Application of these Terms and Conditions

By registering to attend one of our classes, workshops or events, you are agreeing to the terms and conditions set out below and they will be incorporated into the contract between you and Make Creative Studio. The contract is formed when we send you a booking confirmation. Please ensure that you have read and understood the following terms and conditions. If you are booking on behalf of a child or on behalf of any number of other individuals, it is your responsibility to ensure that those individuals are made aware of these terms and conditions and that they comply with them. 

 

In these booking terms, “we/us/our” means Make Creative Studio and “you/your” means our customer or potential customer under these terms. 

 

2. Booking and Payment Terms

2.1 Bookings

Following a booking enquiry and once you have made payment, we will send you a booking confirmation and your booking is then secured with us. Until we receive payment from you, we reserve the right to release your booking to another customer. We are unable to reserve spaces outside of this booking process.

 

2.2 Payments

You can pay for all classes and workshops via our online payment system Please ensure to include your surname as reference for the payment.

 

We reserve the right to changes prices at any time, but changes will not affect any payments which have already been made. 

 

3. Deposits, Refunds and Cancellations

 

3.1 Changes or cancellations by you:

 

3.1.1. ‘Young Makers’ weekly classes 

If you are unable to attend a class in a pre-paid block of classes, please let us know as soon as possible. There will be no refund or credit for any classes missed and we are not liable for any loss of time due to lateness or missed sessions.

  

3.1.2. ‘Magpies’ Upcycling Workshops

Bookings for upcycling workshops are non-refundable. No shows will not be eligible for a refund or credit.

 

3.1.3. ‘Make Your Day’ Party Workshops 

If a ‘Make Your Day’ Workshop is booked in advance of 28 days before the date of the intended workshop, a deposit of 50% of the cost of the workshop is payable in order to confirm the booking and to enable us to secure the venue for your booking.  

 

If a cancellation is made in writing to hellomakecreativestudio@gmail.com up to 28 days in advance of the workshop date, you will be offered a refund of 50% of your deposit. The remaining 50% of your deposit is non-refundable to cover administration charges and cancellation of the venue. 

 

Payment in full of the balance of your workshop cost is due 28 days in advance of the date of the workshop. This payment will include final confirmation of numbers for your workshop to enable materials to be sourced. Places cannot be refunded/credited after this date. If payment is not made in full 28 days in advance of the date of the workshop, we reserve the right to cancel the booking and to release the date to other customers and your deposit becomes non-refundable in full. 

 

If a cancellation is made after 28 days before a workshop, we are unable to offer you a refund or credit. No shows will not be eligible for a refund or credit.

 

If the booked party arrives at the activity with more people than confirmed and paid for, Make Creative Studio’s responsibility to the party or the activity will no longer apply and we reserve the right to cancel the activity. This may be because the venue is not able to accommodate the increased number of people or for any other reason. Should the activity be able to proceed with the additional headcount, payment is immediately due for any additional people attending and must be made before they are able to join the workshop.

 

3.1.4 ‘Make/Sew Bold’ Jane Austen themed workshops

Following purchase of a workshop, if a cancellation is made in writing to hellomakecreativestudio@gmail.com up to 28 days in advance of the workshop, you will be offered a refund of 50% of the cost of the workshop. 

 

If a cancellation is made after 28 days before a workshop, we are unable to offer you a refund or credit as materials will have been sourced and a venue booked. You can transfer your place to another person but please email us to confirm the change of booking name. 

No shows will not be eligible for a refund or credit.

 

3.2. Changes or cancellations by us:

We endeavour to run every class and workshop but on occasion we may be forced to cancel a class or workshop (e.g. due to a tutor being unwell or due to insufficient bookings). In the event that we have to cancel, we will give you as much notice as possible and fees paid will be refunded or we can seek to transfer you to an alternative date. We will not be liable for any other costs or consequential losses, including wasted travel or expenses that you may incur. 

 

We will not be liable or pay you compensation, damages or a refund if our contractual obligations to you are affected by any event which we cannot, even with all due care, foresee or avoid. This includes but is not limited to: war or threat of war, strikes, riots, industrial dispute, terrorist activity, natural or nuclear disaster, pandemic, fire, adverse weather conditions, technical problems affecting transport or any similar events beyond our control. 

 

3.3. Change of venue:

In the rare event that we need to change the venue of the class or workshop from that stated at the time of booking, we will inform you of this change as soon as possible. We will endeavour to replace the stated venue to a similar venue in the central Bath area. In the case of weekly classes, we will discuss with you if there are valid reasons why your child cannot attend the re-arranged venue. We will not be liable for any extra costs or expenses incurred due to a change of venue.

 

4. Class and Workshop Requirements

 

4.1. Age Policy

Our classes and workshops specify an age range in the description. If you have booked and paid for a class or workshop and the student is under or over the specified age range without our prior agreement, the student will be turned away with no refund.

 

4.2. Additional Support

If you, your child or anyone in your group needs additional support, please ensure to provide us with the relevant details at the time of booking. We can then review whether reasonable adjustments can be made and confirm to you what support can be provided.

 

4.3. Conduct

Our tutors will show you how to use any equipment safely. Please do not operate any equipment (such as irons, sewing machines or sharp implements) if you are under the influence of alcohol or drugs or do not feel confident to use them safely.

 

Alcohol or drugs of any kind are not permitted to be brought to our classes or workshops. If, at our sole discretion, we believe any person is under the influence of alcohol or drugs of any kind, we reserve the right to restrict their participation in the activity and/or ask them to leave and we will not be liable to refund you or make any other payment to you. 

 

During any of our classes or workshops, if you (or your child) act in any way which we (at our absolute discretion) deem likely to cause any harm or nuisance to any person(s), you/your child will be required to leave and we will not be liable to refund your payment or make any other payment to you.

 

5. Arrival & Collection

 

5.1. Late Arrivals

If you, your child or any of your group are late in arriving / starting a class or workshop, your session will still finish at the previously confirmed time. If you, your child or any of your group anticipate being late, please contact us to let us know in advance where possible.

 

5.2. Collection (applicable to ‘Young Makers’ & ‘Magpies’)

Please confirm when booking a place who will be collecting your child or, if they are over 11 years old, your consent for them to leave the class unaccompanied. If a child is under 11 years old and/or we do not have your written consent for them to leave unaccompanied, they will only be released to the adult (over 18 years old) or sibling (over 16 years old) who you have confirmed in writing to us. We will not release a child to any person unknown to us without your consent. 

 

5.3. Late Collection (applicable to ‘Young Makers’ & ‘Magpies’)

If you know you are going to be late collecting your child, please call us at the earliest opportunity and discuss with the member of staff teaching your child the arrangements for collection. 

 

We charge a late collection fee of £50 if you are over 15 minutes late to collect your child. The late fee increases by £50 for each subsequent 15 minutes. This late fee covers the cost of a member of staff waiting with your child. 

 

6. Health and Safety 

 

6.1. Use of the venue

You must comply at all times with all requests from us or the venue with regard to health and safety and failure to do so will result in you being asked to leave the class or workshop (in which case no refund will be provided to you). 

 

We will take reasonable steps to avoid any damage but are not responsible for any damage caused to your clothing or belongings due to misuse (accidental or otherwise) of our materials, tools or equipment. Please feel free to bring an apron or wear old clothes to our activities. For Young Makers classes, clothing protection will be provided.

 

You must keep your personal belongings with you at all times and we accept no liability for any damage to, loss of or theft of any of your belongings or other items brought to a class or workshop by you.

 

6.2. Use of sewing machines, irons and other electrical equipment 

Use of any equipment provided for the class or workshop is at our sole discretion. Equipment can only be used at the direction of and in strict compliance with the instructions of the tutors in accordance with our insurance requirements. We are not responsible for unsafe operation of any equipment should you or any member of your party be intoxicated.

 

6.3. Accidents and emergencies (applicable to ‘Young Makers’ or ‘Magpies’)

In the event of an accident or an emergency involving your child at a ‘Young Makers’ or ‘Magpies’ class or workshop, we will call you to inform you of what has happened. If the accident is minor, we will log this in our accident book and your child will take a note of the accident home with them for your records. Should a serious accident occur, we will call an ambulance and contact you via the emergency contact number(s) provided for your child. 

 

It is very important that you keep us promptly updated of any change to your contact details and remain contactable for the duration of the class / workshop. 

 

7. Limitation of Liability

While every reasonable precaution is taken by us to ensure security and safety at our classes and workshops, we shall not in any way be liable for any loss or damage suffered by you or the persons you are booking on behalf of whatsoever in relation to the class, workshop or activity. Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, any fraudulent misrepresentation or any other liability for which it is unlawful to exclude or limit liability. Our total liability for any matter arising out of the contract shall in all circumstances be limited to the price paid by you for the class, workshop or activity and we shall not in any circumstances be liable to you for any consequential loss whatsoever. 

 

8. Photography and Video Recordings

From time to time, we may photograph or film our classes and workshops. We reserve the right to do so for promotion purposes unless you explicitly notify us upon booking that you or your child does not wish to be photographed or filmed.

 

9. Disclaimer

Information provided on our Instagram page or via other social media or marketing materials is for general information purposes only. The information is provided by Make Creative Studio and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the source of the information or the information, products or services for any purpose. Any reliance you place on such information is strictly at your own risk.

 

You acknowledge that such information and materials may contain inaccuracies or errors. Please note that such errors may relate to our services or products, pricing and/or availability. In these circumstances, we have the right to terminate any bookings involving pricing errors or inaccuracies. Make Creative Studio’s decision is final. 

 

10. Intellectual Property

The copyright for all activities, designs and materials used during a class or workshop belongs to us. Information on our Instagram page or on any other social media platform, website or marketing material and the content thereof is copyright of Make Creative Studio.

 

11. Data Protection and Privacy

We will communicate with you using the contact details provided when you make your booking for the purposes of the class or workshop booked. Our Privacy Notice is annexed to these Terms and Conditions and can also be found on our Instagram page (@makecreativestudio). 

 

12. Governing Law

These terms shall be governed by English law.
